By downloading, installing, or using the EasyBorder application or accessing our website, you represent that you have read, understand, and agree to be bound by these Terms. If you do not agree, do not use our Services. You must be at least 18 years old or have parental or guardian permission to use the Services.
EasyBorder (“we”, “us”, or “our”) is not a law firm or lawyer referral service. No employee or representative of EasyBorder is acting as your attorney, and no attorney-client relationship is created by your use of the Services. The Services do not constitute legal advice and do not substitute for advice from a licensed immigration attorney. EasyBorder is not affiliated with USCIS or any government agency.
Your acceptance of these Terms constitutes acceptance of our Privacy Policy, which is incorporated herein by reference.
1. Description of Services
EasyBorder is a mobile application designed to assist users in completing U.S. government immigration forms. The Services provide:
- Guided questionnaires for form completion
- PDF generation of completed forms
- Encrypted local storage of application data on your device
- Multi-language support for questionnaires
- Optional encrypted answer sharing between paired users (e.g., petitioner and beneficiary)
2. Supported Forms
EasyBorder currently supports the following U.S. government immigration forms:
- Form I-129F – Petition for Alien Fiancé(e) (USCIS)
Additional forms may be added in future updates. These Terms apply to all forms supported by the App now or in the future. The App will clearly indicate which forms are available at the time of use.
3. Permitted Use
3.1 Personal Use Only
We grant you the right to access and use the Services solely for personal, non-commercial use. The App and its content are proprietary and protected by U.S. and international copyright and intellectual property laws. We reserve the right to suspend, cancel, or limit your use of the Services with or without cause and without notice if you violate these Terms.
3.2 No Infringing Use
By downloading or installing the App, you agree to a non-transferable, non-exclusive, limited license to install and use the App solely for personal, non-commercial use. You may not use the App in ways that could damage, disable, overburden, or impair the App or interfere with others' use and enjoyment. You are solely responsible for your use of the App and any consequences arising from a breach of these Terms.
3.3 Prohibited Use
As a condition of using the Services, you agree not to:
- Use the Services for any unlawful purpose or to encourage illegal behavior
- Use automated tools, bots, scrapers, web crawlers, or any other automated means to access, copy, collect, or monitor the App, website, or any content without our prior written consent
- Attempt to derive source code from, decompile, reverse engineer, or disassemble the App
- Circumvent or defeat any security features or content usage rules in the App
- Remove, obscure, or alter any copyright notices, trademarks, or proprietary rights notices in the App
- Use the Services in ways that could damage, disable, overburden, or impair the Services or interfere with others' use
Unauthorized automated access may result in immediate termination of your access and may subject you to legal action.
4. User Responsibilities
4.1 Accuracy of Information
You are responsible for ensuring that all information provided in the App is accurate, complete, and truthful. You understand that providing false or misleading information on immigration forms may result in visa denial, application rejection, or other legal consequences.
4.2 Legal Compliance
You agree to use the App in compliance with all applicable laws and regulations, including U.S. immigration laws.
4.3 Data Security
Your immigration data is stored locally on your device in an encrypted database. You are responsible for maintaining the security of your device and any backup systems you use. If you delete the App, your locally stored data will be permanently removed.
5. In-App Purchases
Certain features of the App may require a one-time in-app purchase. All purchases are processed through the Apple App Store or Google Play Store and are subject to their respective terms and conditions. We do not directly collect or process your payment information.
- All purchases are non-consumable and yours permanently once completed
- Purchase prices do not include USCIS government filing fees
- Refund requests are handled by Apple or Google according to their respective refund policies
- You may restore previously completed purchases on the same platform using the “Restore Purchases” feature in the App's settings
6. Translation Accuracy
EasyBorder provides content, questionnaires, and guides in multiple languages — including Spanish, Portuguese, Vietnamese, and Tagalog — to make the immigration process more accessible. While we make every effort to ensure translations are accurate and up to date, translations are provided for convenience only and may contain errors or inaccuracies. In the event of any conflict or inconsistency between the English-language version and any translated version of these Terms or our content, the English version shall prevail. You should not rely solely on translated content for legal or immigration decisions.
7. No Legal Advice
The Services may include access to certain legal information, articles, guides, and immigration forms. Such information is provided for general informational purposes only and does not constitute legal advice. You should not rely on it as such.
- Government processes, policies, and immigration laws change regularly; we cannot guarantee all information, forms, or documents provided via the Services are current or correct
- The Services do not substitute for advice from a competent immigration attorney
- We make no guarantees that using the Services will result in a successful immigration outcome
- We strongly recommend consulting with a licensed immigration attorney for advice specific to your situation
8. Intellectual Property
The App and all content, features, and functionality (including but not limited to software, text, graphics, logos, and design) are owned by EasyBorder and are protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the App without our prior written permission.
9. Third-Party Services and Links
The Services may contain links to third-party websites or services. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You access third-party websites entirely at your own risk.
10. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT OR GUARANTEE THAT:
- The App will be error-free, uninterrupted, or free of viruses or harmful code
- Generated forms will be accepted by USCIS or any government agency
- The information provided meets current USCIS requirements
- The App is suitable for your specific immigration situation
EASYBORDER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE.
11. Limitation of Liability
UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO BREACH OF CONTRACT, TORT, OR NEGLIGENCE, SHALL EASYBORDER BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS, LOSS OF DATA, OR COST OF REPLACEMENT SERVICES) ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
IN NO EVENT SHALL EASYBORDER'S AGGREGATE LIABILITY TO YOU FOR ANY LOSS, DAMAGE, OR CLAIM RELATED TO OR ARISING FROM THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNTS PAID BY YOU TO EASYBORDER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) FIFTY U.S. DOLLARS ($50.00).
12. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless EasyBorder and its directors, officers, employees, and agents from and against any and all claims, actions, suits, or proceedings, as well as any and all losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any information you provide through the Services.
13. Privacy
Your privacy is important to us. Please review our Privacy Policy, which describes how we collect, use, and safeguard information when you use the Services. The Privacy Policy is incorporated into and forms part of these Terms.
14. Termination
These Terms continue until terminated by either you or EasyBorder. You may terminate these Terms at any time by deleting the App from your device and ceasing to use the Services. We may terminate or suspend your access to the Services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Your rights under these Terms will automatically terminate if you fail to comply with any provision.
15. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will update the “Last updated” date at the top of this page and post the revised Terms. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
16. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Neither the United Nations Convention on Contracts for the International Sale of Goods nor any Uniform Computer Information Transactions Act enactment applies to these Terms.
Any dispute relating to your use of the Services shall be submitted to confidential arbitration in Florida, except that to the extent you have violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief in any state or federal court in Florida. You consent to and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in Florida state and federal courts.
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of, related to, or connected with the Services or these Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred.
17. General Provisions
These Terms and our Privacy Policy constitute the final, complete, and exclusive agreement between you and EasyBorder and supersede all prior discussions. If any provision of these Terms is held invalid or unenforceable, that provision shall be struck and the remaining provisions shall be enforced. Our failure to act regarding a breach does not waive our right to act regarding subsequent or similar breaches. The rights granted in these Terms may not be assigned or transferred by you without our prior written approval.
18. Children
The Services are not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. Parents or legal guardians may use the Services on behalf of their children in compliance with these Terms.
